Casa Maria — Agency Policies & Terms

Welcome to Casa Maria. We represent a curated roster of premium digital creators across London and Lisbon. To ensure operational excellence, transparency, and the mutual protection of our talents and brand partners, all engagements are governed by the following core policies.

1. Representation & Commission Structure

  • The Model: Casa Maria operates on a strict 20% agency commission model on all secured brand partnerships, paid campaigns, gifting integrations, and creative direction contracts across the entire roster.

  • Exclusive Representation: For talents signed under our Exclusive Management contract, Casa Maria acts as the sole and exclusive commercial representative globally. All inbound brand inquiries, PR requests, and gifting offers received directly by the talent must be forwarded immediately to management (kylegood@atcasamaria.com) for vetting, negotiation, and invoicing.

  • Non-Exclusive Representation: For talents signed under our Non-Exclusive contract, representation applies to agency-secured or materially facilitated deals. To prevent commercial conflict, scheduling overlaps, or double-booking, non-exclusive talents must disclose independent negotiations to the agency prior to signing external agreements.

2. Payment Terms & Financial Operations

  • Invoicing & Collection: All campaign invoices are issued directly by Casa Maria MGMT.

  • Standard Terms: Payment terms are strictly Net 30 days from receipt of invoice or completion of deliverables, unless explicitly negotiated otherwise in writing prior to campaign kickoff.

  • Late Payments: Late payments disrupt operational cash flow. Payments delayed beyond agreed terms may incur a standard late fee penalty, and representation/deliverables may be temporarily suspended until balances are cleared.

  • Disbursement: Client funds are processed through Casa Maria. Talent payouts are disbursed promptly following the deduction of our 20% agency commission.

3. Content Creation & Deliverable Approvals

  • Production Integrity: Deliverables (Instagram Posts, Carousels, Reels, Story Sets) are produced to the high editorial standards of the Casa Maria aesthetic.

  • Review Process: Brands are entitled to one (1) round of preview edits strictly for factual accuracy and brand-safety compliance. Creative direction, styling, and aesthetic execution remain under the complete control of the talent.

  • Reshoots: Requests for full creative reshoots due to a change in brand brief post-production will incur an additional fee equivalent to 50% of the original content creation rate.

4. Media Licensing & Usage Rights (Strictly Enforced)

  • Scope of Standard License (Organic Only): All baseline content creation fees cover Organic Social Media Distribution Only on the Talent’s owned and operated channels for a permanent or agreed duration. This baseline fee does not grant the Client, its affiliates, or any third-party agency the right to download, alter, distribute, republish, or run paid amplification behind the assets.

  • Paid Amplification & Whitelisting Multipliers: If the Client wishes to use the Talent’s assets for Paid Social Advertising (including Meta Ads Manager, TikTok Spark Ads, Whitelisting, or Dark Posting), an explicit Licensing Addendum must be executed. Paid usage is strictly billed using the following agency multipliers based on the Total Campaign Fee (TCF):

    • 1 Month: +20% of TCF

    • 3 Months: +50% of TCF

    • 6 Months: +90% of TCF

    • All licensing fees are subject to the standard Casa Maria 20% agency commission.

  • Multi-Channel Commercial Licensing: The use of Talent assets on the Client’s website, email marketing, print media, or Out-of-Home (OOH) billboards is strictly prohibited under standard agreements. Any retail or multi-channel use must be negotiated independently through Casa Maria MGMT prior to content delivery and will carry premium commercial market rates.

5. Unauthorized Usage Penalty Clause

  • Active Monitoring: Casa Maria actively monitors digital spaces for unauthorized usage of our roster's intellectual property.

  • The Penalty: If a brand or agency utilizes, runs paid ads against, or amplifies a Talent's asset without a signed licensing agreement or past the expiration date of an agreed term, an immediate, non-negotiable Unauthorized Usage Penalty fee equal to 300% of the baseline campaign rate will be invoiced daily until the asset is entirely removed or a retroactive license is purchased.

  • Legal Enforcement: Legal fees incurred by Casa Maria to enforce asset takedowns will be billed entirely to the offending Client.

6. Category Exclusivity Lockouts

  • Baseline Non-Exclusivity: Baseline rates do not include category exclusivity. The Talent remains entirely free to work with direct marketplace competitors.

  • Exclusivity Premium: If a brand requires a category lockout (e.g., no other skincare, footwear, or workwear brands for 30 days), this must be bought upfront at a premium of +30% to +50% of the base campaign fee, depending on the length and severity of the restriction.

7. Cancellations & Postponements

  • Standard Kill Fees: If a campaign is canceled by the brand after contracts are signed but before content creation begins, a 25% cancellation fee applies.

  • Production Kill Fees: If cancellation occurs after content has been shot or produced, a 100% kill fee is mandated to compensate the talent for production time and exclusivity lockouts.

  • Postponements: Shifting live posting dates by more than 14 days requires written notice and may incur a rescheduling administrative fee.

8. Confidentiality

  • Both Casa Maria talent and corporate brand partners agree to maintain absolute confidentiality regarding campaign fees, proprietary strategy briefs, internal communication, and specific contract terms.
